Why do we need your explicit consent to use cookies?
The Guide of the Spanish Data Protection Agency (AEPD), July 2023, with contributions and criteria from the European Data Protection Board (EDPB), GDPR-EU-2016/679 — articles 5, 6, 7 and 13 — and LOPDGDD-3/2018 — article 6 — must be interpreted to mean that consent is only valid if it is explicit.

Consent of minors: GDPR-EU-2016/679, Article 8, sets out conditions applicable to the consent of minors in relation to information society services.
1. Where Article 6(1)(a) applies, in relation to the direct offer of information society services to minors, the processing of their personal data shall be lawful where the child is at least 16 years old. If the child is under 16, such processing shall only be lawful if and to the extent that consent is given or authorised by the holder of parental responsibility or guardianship over the child.
2. The controller shall make reasonable efforts to verify in such cases that consent is given or authorised by the holder of parental responsibility or guardianship over the child, taking into account available technology.
WHAT ARE COOKIES?
Cookies are small data files that are received on the user’s device from the website/APP visited and are used to record certain browsing interactions on a website/APP, storing data that can be updated and retrieved. These files are stored on the user’s device and contain anonymous data that is not harmful to the device. They are used to remember the user’s preferences, such as selected language, login data, or customization of the website or APP.
Cookies or storage devices have traditionally been associated with web pages. However, they are now used both on websites and on other types of platforms and applications (for example, smartphone and tablet apps).
Cookies can also be used to record anonymous information about how a visitor uses a space. For example, which website/APP they came from, or whether they used an advertising banner to access it.
Information society services can be provided by the publisher through a platform, application, or website/APP accessed by a user from their device.
1.- WHY DO WE USE COOKIES?
We use both first-party and third-party cookies to analyze website usage and to display advertising based on preferences derived from a profile created from the user’s browsing habits.
FUNDACIÓ PRIVADA DE L’ESCOLA DEL GREMI DE PASTISSERIA I MUSEU DE XOCOLATA uses Technical and Analytical cookies to allow you to use our website and access secure areas, personalized options, etc. In addition, FUNDACIÓ PRIVADA DE L’ESCOLA DEL GREMI DE PASTISSERIA I MUSEU DE XOCOLATA uses cookies that collect data related to website usage analysis. These are used to help improve the user service by measuring the use and performance of the page in order to optimize and personalize it.
2.- WHAT USE DO WE GIVE TO THE DIFFERENT TYPES OF COOKIES?
According to their purpose:
• Technical cookies: these allow the user to navigate through a website, platform, or application and use the different options or services available. For example, those used for session maintenance, response time management, performance or option validation, security features, and content sharing.
• Preference or personalization cookies: these allow information to be remembered so that the user accesses the service with certain characteristics that may differentiate their experience from that of other users. Examples include language, number of results shown in a search, appearance or content of the service depending on the type of browser used or the region from which the user accesses it, etc.
• Analytical or measurement cookies (analytics): These are cookies that allow the party responsible for them to track and analyze the behaviour of users of the websites or APPs they are linked to, including the measurement of advertising impacts. The information collected through these cookies is used to measure website, application, or platform activity, with the aim of introducing improvements based on the analysis of user behaviour data.
• Advertising/marketing cookies: These are cookies that, processed by the website (or APP) administrator or by third parties, allow the analysis of users’ browsing habits in order to show advertising related to the user’s browsing profile. Advertising cookies allow the management of advertising spaces based on specific criteria.
They store information about user behaviour, obtained through continuous observation of browsing habits, which makes it possible to develop a specific profile in order to display advertising accordingly.
Types of cookies according to the period they remain active:
• Session cookies: These are designed to collect and store data while the user accesses a website/APP. They are usually used to store information that is only relevant for providing a service requested by the user on a single occasion (for example, a list of purchased products) and disappear when the session ends.
• Persistent cookies: These are cookies whose data remains stored on the device and can be accessed and processed for a period defined by the cookie controller, which can range from a few minutes to several years. In this regard, it is important to assess whether the use of persistent cookies is necessary, as privacy risks can be reduced by using session cookies. In any case, when persistent cookies are installed, it is recommended to minimise their duration as much as possible according to their purpose.
The legal obligations imposed by the regulations are two: the obligation of transparency and the obligation to obtain the user’s explicit consent on the website/APP.
In accordance with the nature of their business activity, the business model they develop, and the scope of their responsibility, it is recommended to carry out a review of the cookies used, either internally or with the advice of specialised entities.
This review will aim to identify the cookies being used, analysing whether they are first-party or third-party cookies, session or persistent cookies, and specifying their function in order to determine whether or not they fall within the scope of Article 22.2 of the LSSI. Given the possible changes that may occur in the management and use of cookies, it is recommended to carry out this review periodically in order to update the available information about these cookies. In any case, it should be taken into account that the solutions implemented to comply with the obligations of Article 22.2 of the LSSI should be technologically neutral, meaning they should be solutions recognised by most browsers.
3. LINK FOR COOKIE IDENTIFICATION:
It is advisable that the information provided regarding cookie management (including how to revoke consent and delete cookies) is permanently accessible through the website, application, or online service in question. To this end, without prejudice to other possible solutions, this requirement is considered fulfilled when the cookie management system (configuration panel or a CMP, which allows website or APP owners to obtain, manage, and distribute consumer consent) is integrated into the cookie policy itself or when it includes a link that directly leads to the management system or configuration panel.
AEPD Guide, 3.2.10. Possibility of denying access to the service in case of cookie rejection:
There may be certain cases in which not accepting the use of cookies prevents access to the website or the full or partial use of the service, provided that the user is properly informed of this fact and is offered an alternative, not necessarily free of charge, to access the service without the need to accept cookies.
These cookies must comply with GDPR-EU-2016/679, LOPDGDD-3/2018, the LSSI-CE-34/2002 regulation (latest amendment of 09/05/2023), and the AEPD Cookie Guide of July 2023 with EDPB criteria.
